5101:2-47-13 Title IV-E foster care maintenance (FCM) program eligibility: Legal responsibility requirements.

This rule is being amended in accordance with the Administration on Children, Youth and Families, ACYF-CB-PI-18-07, and Public Law 115-123, Family First Prevention Services Act (FFPSA). Changes were made to Title IV-B and IV-E of the Social Security Act, enacted February 9, 2018 which outlined limitations on title IV-E foster care maintenance payments for placements that are not foster family homes, as defined in section 472(k) of the Act. Rules are being amended to instruct title IV-E agencies on the implementation and limitations of title IV-E foster care maintenance eligibility and reimbursability. The rules will be effective October 1, 2021.
